Grocery Outlet Continues 'Lucky' Legacy with Brands Inside Store

BERKELEY, Calif. -- While shoppers in Northern California may not see the Lucky banner outside any Grocery Outlet-owned stores, the extreme value discounter pushes on with Lucky's well-known Lady Lee and Harvest Day store brands.

"The brands were very popular and have a long history," Jon Wylie, Grocery Outlet's v.p. of marketing told Progressive Grocer. "Unlike the Lucky name, which Albertsons owned but didn't use, the trademarks on Lady Lee and Harvest Day expired. We registered for them in March."

Last month, Boise, Idaho-based Albertsons LLC, which was purchased by the Cerberus-led consortium and also lays claim to the Lucky name, had won a ruling in the legal battle against Berkeley, Calif.-based Grocery Outlet for the brand. District Judge Jeffrey S. White of San Francisco granted Albertson's request for a preliminary injunction blocking Grocery Outlet from using the name.

Grocery Outlet is currently appealing that court's decision.
