Former Food Broker Pleads Guilty to Fraud of Demoulas Supermarkets
BOSTON - A former food broker for Advantage/ESM was convicted on Monday in federal court of receipt of stolen securities and monies taken from Tewksbury, Mass.-based Demoulas Supermarkets, the U.S. Attorney's office reports.
Robert McCarthy, age 49, of Duxbury, Mass., pleaded guilty before U.S. District Judge Mark L. Wolf to receipt of stolen securities and monies. His hearing follows those of Wayne Dick and Daniel Martin, who previously pleaded guilty to charges of receipt of stolen property and subscribing to false income tax returns in connection with the case.
At the plea hearing, the prosecutor told the Court that had the case proceeded to trial, the government's evidence would have proven that from the fall of 1998 to May, 2000, McCarthy, a food broker for Advantage/ESM, was involved in the theft of monies by food brokers and buyers associated with Demoulas Supermarkets. The theft involved more than $400,000 in stolen checks, which food manufacturers that McCarthy represented thought were being paid to
Demoulas Supermarkets for advertising expenses.
As a food broker for Advantage/ESM, McCarthy represented such companies as Lipton, McCormick Spices, Kal-Kan, and New World Pasta. He made regular sales calls to Demoulas and negotiated deals with Demoulas food buyer, Wayne Dick, for advertising space on behalf of his clients.
Judge Wolf scheduled sentencing for McCarthy on Nov. 20, 2002. McCarthy faces up to 10 years' imprisonment, to be followed by three years of supervised release, and a $250,000 fine on the charges. Wayne Dick and Daniel Martin also are scheduled to be sentenced in November.
