Court Decertifies Dollar General Suit

GOODLETTSVILLE, Tenn. -- Dollar General Corp. here said yesterday that the judge presiding over a collective action lawsuit facing the company has decertified the class, which had comprised approximately 2,500 people.

The judge has ruled that the 12 named plaintiffs in the lawsuit can continue with the case.

Dollar General said that it plans to continue to defend its position in this case, and that at this time, it doesn't believe an adverse resolution will have a material effect on the company's financial statements taken as a whole. The company doesn't know whether the plaintiffs intend to challenge the ruling.

The suit was originally filed in federal court in Alabama on behalf of Edith Brown and other salaried store managers. The plaintiffs allege they weren't paid overtime, although they qualify for it under the Fair Labor Standards Act.
