Albertsons Hits the Back Rooms and Archives for Ammo in Battle to Get Lucky

BOISE, Idaho -- In the ongoing battle between Albertsons and Grocery Outlet for the Lucky name, Albertsons routed a memo to its Northern California store managers and staff, looking to gather any items displaying the Lucky name to help the company defend its claim that it still owns the once-popular California brand. Albertsons also began running ads in local papers using the Lucky logo.

The memo, obtained by Progressive Grocer from a source on the West Coast reads:

"Store directors and staff: Urgent and Important

"The company is in need of any documents, signs, or other items displaying the Lucky name. These logos could be on grocery carts, signs, back rooms, or forms. Please check your supply closet for any old forms or new forms that we still use. If a photograph is used, please note time, place, and who took the picture. In addition, please note approximately how long the logo has existed at the location.

"The company needs this information because a competitor may be trying to use the Lucky name. Because Albertsons owns the name, we would like to protect the Lucky name.

"Please take a picture or send the document to my attention. Also, as you see and find these items, please e-mail me immediately that you have found some information that we can pass on to Boise."

The memo was signed by Jim Perkins, regional v.p. at Albertsons Northern California Store Support Center.

Last week a federal Judge of the Ninth Circuit Court denied Albertsons' request for a temporary restraining order against Grocery Outlet's use of the Lucky brand, paving the way for Grocery Outlet's plans to open future stores under the once-popular banner. There will be a hearing on the matter in the near future.

Albertsons was not available to comment at presstime.
