Supermarket Sues Over Confidential Yahoo! Postings

Nash Finch has filed a lawsuit alleging that "person or persons unknown--possibly employees--posted confidential information" about the company on a Yahoo! message board. The Edina, Minn.-based company's suit claims "breach of contract and misappropriation of trade secrets" and stipulates that if "the defendants turn out to be current or former employees, they would have violated Nash Finch's Code of Ethics and Business Conduct and Associate Handbook."

The lawsuit, filed in Yahoo!-headquartered Santa Clara County, Calif., does not name specific defendants, but refers to them as "John Does" and lists them numerically, 1 through 50. Nash Finch said it will amend its claims once the names are uncovered, which its lawyers, California-based Latham & Watkins, are seeking from Yahoo! through a subpoena.

Details and dates of the Yahoo! postings have not been revealed, but the company states in its lawsuit that "irreparable injury" was done to its business, including the release of "confidential, proprietary financial information belonging to Nash Finch."

Nash Finch reported more than $4 billion in annual revenues for its last fiscal year.
