Roundy’s Sued Over Fingerprint Data

Kroger subsidiary Roundy’s, which operates the popular Chicago-area grocery chain Mariano’s, is among several defendants recently sued in Cook County for allegedly violating privacy laws protecting employee fingerprint data.

In the lawsuits, for which class-action status is pending, Roundy’s and other companies are accused of failing to get written approval and provide proper written disclosures about the collection, use and storage of fingerprints and handprints, the Chicago Tribune reported.

Under the Illinois Biometric Information Privacy Act, employers must tell people in writing that the data will be collected and how they will be used.

The other defendants are Intercontinental Hotels' Kimpton chain and data center operator Zayo Group.

When asked for comment, Roundy’s spokesman James Hyland told Progressive Grocer that the company doesn't comment on pending litigation.

Roundy's estimated in a court filing that damages in one lawsuit could potentially cost the company $10 million, the Tribune reported.

Employers can use biometric information such as fingerprints to monitor employees’ work hours and control their access to sensitive areas.
