Grocery Outlet Still Feeling Lucky
BERKELEY, Calif. -- A month after it converted its Rocklin, Calif. store to the Lucky banner, touching off a legal battle with Boise, Idaho-based Albertsons over the rights to the name, Grocery Outlet here said yesterday that it's opening additional Lucky locations in Vacaville and San Leandro, Calif., according to a published report.
When the Rocklin store opened, Albertsons sued, claiming that it still owned the name and the logo. Grocery Outlet countered that Albertsons had abandoned both when it converted the Lucky stores it bought in 1998 to the Albertsons banner a year later. Albertsons maintains that Grocery Outlet's aim is to confuse consumers.
A judge turned down Albertsons' request that the Rocklin store discontinue using the Lucky name and logo, but the lawsuit continues.
The Vacaville Lucky store, a conversion from an existing Grocery Outlet site, will open in around 60 days, while the San Leandro location will be a ground-up store, with construction slated to start in three weeks.
